Tell us a about your law firm

What impact do you expect the EU Whistleblowing Directive, and its adoption into national law, to have on organisations in Bulgaria?

The Directive will undoubtedly contribute not only to the harmonisation of the currently fragmented legislation in the reporting against breaches of European law, but also to the improvement of transparency in companies. This will inevitably reflect on the reduction of various offenses. Businesses need to realise that the new rules are not intended to increase the administrative burden on businesses, but to prevent various illegal activities. The creation of internal reporting channels is extremely important, not only because of the requirements of the EU Whistleblowing Directive, but also for the image of the companies in Bulgaria themselves. The possibility to report directly to a national competent authority would pose a serious reputational risk to companies if someone chooses to report irregularities externally.

Do you think there will any significant differences between the EU Whistleblowing Directive and the local adoption of the law in Bulgaria?

I do not believe that there will be significant differences between the provisions of the Whistleblowing Directive and the law with which it will be transposed in Bulgaria. However, the directive establishes common minimum standards that ensure effective protection of those who report irregularities. Of course, each EU member state, including Bulgaria, has its own national specifics, which are likely to have an impact on the implementation of the EU Directive. At the moment, however, this is difficult to predict, as there is a new government in Bulgaria recently. There will be more clarity in the coming months.

What made you partner with Whistlelink?

Какво въздействие очаквате да има Директивата относно защитата на лицата, които подават сигнали за нарушения на правото на Съюза и нейното приемане в националното законодателство върху организациите в България?

BG – Директивата безспорно ще допринесе, освен за хармонизирането на разпокъсаното в момента законодателство в областта на докладването на сигнали против нарушения на европейското право, така и за подобряването на прозрачността в компаниите, което неминуемо ще рефлектира върху намаляването на случаите на различни правонарушения. Бизнесът трябва да осъзнае, че новите правила не целят да се увеличи административната тежест за предприятията, а целят превенция на различни противоправни дейности. Създаването на вътрешни канали за докладване е изключително важно, не само заради изискванията на Директивата, но и за имиджа на самите компании. Предвидената възможност да се докладва директно на национален компетентен орган би нанесло сериозен репутационен риск на компаниите, когато се докладва външно за дадено нарушение.

Считате ли, че ще има съществени различия между Директивата относно защитата на лицата, които подават сигнали за нарушения на правото на Съюза, и националното ви законодателство ?

BG – Не вярвам да има съществени различия между разпоредбите на директивата и законът, с който тя ще бъде транспонирана у нас – все пак директивата установява общи минимални стандарти, с които се гарантира ефективна защита на лицата, сигнализиращи за нередности. Разбира се, всяка държава членка на ЕС, включително и България има своите национални специфики, които най-вероятно ще окажат влияние при имплементиране на директивата. Към момента обаче това е трудно да се предвиди, тъй като в България съвсем отскоро има ново правителство и в следващите месеци ще има повече яснота.

Какво ви накара да си партнирате с Whistlelink? 

BG – Това, което ни накара да си партнираме с Whistlelink, на първо място бе тяхната проактивност. Месеци преди крайния срок за имплементиране на директивата в страните членки, Whistlelinк бяха създали проекти на необходимите канали за съобщаване на нарушения, които могат да се използват от компаниите.
