Jak\u00e9 jsou tedy v\u00fdhody whistleblowingu a pro\u010d se stal tak d\u016fle\u017eit\u00fdm?<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Co m\u00e1me na mysli pod pojmem whistleblowing?<\/h3>\n\n\n\n<p>Kdy\u017e se \u0159ekne whistleblowing, m\u00e1me tendenci myslet na rozs\u00e1hl\u00e9 skand\u00e1ly, jako jsou <a href=\"https:\/\/sv.wikipedia.org\/wiki\/Cambridge_Analytica\" target=\"_blank\" rel=\"noreferrer noopener\">Cambridge Analytica <\/a>a LuxLeaks; st\u00e1le \u010dast\u011bji jsou v\u0161ak hl\u00e1\u0161ena i men\u0161\u00ed poru\u0161en\u00ed p\u0159edpis\u016f. Whistleblowing lze definovat jako akt odhalen\u00ed jak\u00e9hokoli neetick\u00e9ho chov\u00e1n\u00ed ve ve\u0159ejn\u00e9m z\u00e1jmu, bez ohledu na to, jak velk\u00fd nebo mal\u00fd je. M\u016f\u017ee se jednat o finan\u010dn\u00ed podvody, \u00faplatk\u00e1\u0159stv\u00ed, da\u0148ov\u00e9 \u00faniky, poru\u0161ov\u00e1n\u00ed z\u00e1kon\u016f na ochranu \u017eivotn\u00edho prost\u0159ed\u00ed, nez\u00e1konn\u00e9 sledov\u00e1n\u00ed, zdravotn\u00ed a bezpe\u010dnostn\u00ed rizika a trestnou \u010dinnost.<\/p>\n\n\n\n<p>D\u00edky informac\u00edm poskytnut\u00fdm oznamovatelem m\u016f\u017ee b\u00fdt odhalen trestn\u00fd \u010din, kter\u00fd by jinak z\u016fstal nepov\u0161imnut. D\u016fsledky pro pachatele by samoz\u0159ejm\u011b mohly b\u00fdt zna\u010dn\u00e9 a v z\u00e1vislosti na z\u00e1va\u017enosti jeho jedn\u00e1n\u00ed by mohly v\u00e9st i k trestn\u00edmu st\u00edh\u00e1n\u00ed. To je jeden z d\u016fvod\u016f, pro\u010d m\u011bl whistleblowing v minulosti negativn\u00ed konotace. Osoba, kter\u00e1 odhalila protipr\u00e1vn\u00ed jedn\u00e1n\u00ed, byla \u010dasto ozna\u010dena za zr\u00e1dce a trp\u011bla ur\u00e1\u017ekami a odvetn\u00fdmi opat\u0159en\u00edmi.<\/p>\n\n\n\n<p>V posledn\u00edch letech v\u0161ak v Evrop\u011b do\u0161lo k posunu sm\u011brem k propagaci a uzn\u00e1n\u00ed v\u00fdhod whistleblowingu a jeho postaven\u00ed do zcela nov\u00e9ho sv\u011btla. Vl\u00e1dy a organizace uzn\u00e1vaj\u00ed oznamovatele jako z\u00e1sadn\u00ed p\u0159\u00ednos v boji proti trestn\u00e9 \u010dinnosti, kter\u00e1 \u010dasto jinak proch\u00e1z\u00ed pod pokli\u010dkou. Proto je d\u016fle\u017eit\u00e9, aby byli v pr\u016fb\u011bhu cel\u00e9ho procesu oznamovatel\u00e9 chr\u00e1n\u011bni a podporov\u00e1ni, a proto byla v roce 2019 zavedena nov\u00e1 <a href=\"https:\/\/www.whistlelink.com\/cs\/smernice-eu-o-ochrane-osob\/\" target=\"_blank\" rel=\"noreferrer noopener\">sm\u011brnice o whistleblowingu.<\/a><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Nov\u00e1 sm\u011brnice EU<\/h3>\n\n\n\n<p>Po odhalen\u00ed skand\u00e1lu <a href=\"https:\/\/www.svt.se\/special\/swedbank\/danskebank\/\">Danske Bank <\/a>v roce 2017 zah\u00e1jila EU jedn\u00e1n\u00ed o zaveden\u00ed nov\u00fdch opat\u0159en\u00ed zam\u011b\u0159en\u00fdch na boj proti podvod\u016fm. Syst\u00e9m, v n\u011bm\u017e bylo prost\u0159ednictv\u00edm banky b\u011bhem osmi let vypr\u00e1no p\u0159ibli\u017en\u011b 200 miliard eur, byl odhalen d\u00edky tipu jednoho z bank\u00e9\u0159\u016f. Od t\u00e9 doby se na whistleblowing d\u00edv\u00e1 sv\u011bt jinak. Byly zavedeny p\u0159\u00edsn\u00e9 p\u0159edpisy na podporu oznamov\u00e1n\u00ed na pracovi\u0161ti.<\/p>\n\n\n\n<p>P\u0159ed n\u00e1mi je je\u0161t\u011b dlouh\u00e1 cesta, ne\u017e se spole\u010dnosti, <a href=\"https:\/\/www.whistlelink.com\/cs\/blog\/where-countries-are-up-to-in-adopting-the-eu-whistleblowing-directive\/\" target=\"_blank\" rel=\"noreferrer noopener\">jednotlivci i vl\u00e1dy p\u0159izp\u016fsob\u00ed nov\u00fdm sm\u011brnic\u00edm<\/a> a zavedou spr\u00e1vn\u00e9 syst\u00e9my. P\u0159esto jsou tato pravidla d\u016fle\u017eit\u00fdm krokem k zaru\u010den\u00ed ochrany oznamovatel\u016f, co\u017e m\u016f\u017ee n\u00e1sledn\u011b sn\u00ed\u017eit korupci a podvody ve v\u0161ech oblastech. Zpr\u00e1va Evropsk\u00e9 komise odhaduje, \u017ee korupce stoj\u00ed EU ka\u017edoro\u010dn\u011b nejm\u00e9n\u011b 179 miliard eur. To ukazuje, jak je nov\u00fd mechanismus nezbytn\u00fd.<\/p>\n\n\n\n<p>Smyslem nov\u00fdch na\u0159\u00edzen\u00ed je tedy poskytnout oznamovatel\u016fm lep\u0161\u00ed podporu a ochranu, aby se zv\u00fd\u0161il po\u010det ozn\u00e1men\u00ed. V\u010detn\u011b oblasti financ\u00ed, \u017eivotn\u00edho prost\u0159ed\u00ed, ve\u0159ejn\u00e9ho zdrav\u00ed, ve\u0159ejn\u00fdch zak\u00e1zek, bezpe\u010dnosti spot\u0159ebitel\u016f a ochrany \u00fadaj\u016f.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Jak prob\u00edh\u00e1 whistleblowing?<\/h3>\n\n\n\n<p>Jak jsme ji\u017e uvedli v\u00fd\u0161e, roli oznamovatele mohou p\u0159evz\u00edt r\u016fzn\u00e9 osoby a m\u016f\u017ee k tomu doj\u00edt r\u016fzn\u00fdmi zp\u016fsoby. Jedn\u00edm z nejv\u00fdznamn\u011bj\u0161\u00edch rozd\u00edl\u016f je rozd\u00edl mezi intern\u00edm a extern\u00edm whistleblowingem.<\/p>\n\n\n\n<p><span style=\"text-decoration: underline;\"><strong>Intern\u00ed<\/strong><\/span><\/p>\n\n\n\n<p>Kdy\u017e n\u011bkdo uvnit\u0159 organizace, obvykle zam\u011bstnanec, nahl\u00e1s\u00ed \u0161kodliv\u00e9 chov\u00e1n\u00ed nad\u0159\u00edzen\u00e9mu. V tomto p\u0159\u00edpad\u011b jsou informace zve\u0159ejn\u011bny a zpracov\u00e1ny v r\u00e1mci organizace.<\/p>\n\n\n\n<p><span style=\"text-decoration: underline;\"><strong>Extern\u00ed<\/strong><\/span><\/p>\n\n\n\n<p>Kdy\u017e k nahl\u00e1\u0161en\u00ed dojde mimo organizaci. Nen\u00ed pochyb o tom, \u017ee tato praxe by m\u011bla b\u00fdt z\u00e1kladn\u00edm prvkem ka\u017ed\u00e9 organizace.<\/p>\n\n\n\n<p>Whistleblowe\u0159i \u010dasto t\u011b\u017e\u00ed z jedine\u010dn\u00e9ho \u00fahlu pohledu, z n\u011bho\u017e jsou schopni zjistit pochyben\u00ed, a mohou b\u00fdt dokonce jedinou osobou v takov\u00e9 pozici. Chce to odvahu promluvit a odhalit pravdu. Abychom povzbudili jednotlivce k tomu, aby se p\u0159ihl\u00e1sili, je t\u0159eba je chr\u00e1nit p\u0159ed jakoukoli odplatou. Pat\u0159\u00ed sem ve\u0159ejn\u00e9 zdrav\u00ed, \u017eivotn\u00ed prost\u0159ed\u00ed, bezpe\u010dnost spot\u0159ebitel\u016f a ochrana \u00fadaj\u016f. Pod\u00edvejme se na n\u011bkter\u00e9 z nej\u010dast\u011bj\u0161\u00edch oblast\u00ed, v nich\u017e mohou v\u00fdhody whistleblowingu p\u0159in\u00e9st spole\u010dnosti prosp\u011bch.<\/p>\n\n\n\n<p><strong><span style=\"text-decoration: underline;\">Finan\u010dn\u00ed<\/span><\/strong><\/p>\n\n\n\n<p>Odhalov\u00e1n\u00ed finan\u010dn\u00edch podvod\u016f je zcela jist\u011b nejv\u011bt\u0161\u00ed a nej\u010dast\u011bj\u0161\u00ed oblast\u00ed pro oznamov\u00e1n\u00ed podvod\u016f. Jeden ze zam\u011bstnanc\u016f zve\u0159ejnil informace, kter\u00e9 odhalily, \u017ee v\u00edce ne\u017e 300 velk\u00fdch spole\u010dnost\u00ed se pod\u00edlelo na da\u0148ov\u00fdch \u00fanic\u00edch a vyu\u017e\u00edvalo k tomu &#8222;fiktivn\u00ed spole\u010dnosti&#8220; se s\u00eddlem v Lucembursku. Da\u0148ov\u00e9 \u00faniky v tak velk\u00e9m m\u011b\u0159\u00edtku znamenaj\u00ed obrovsk\u00e9 ztr\u00e1ty pro vl\u00e1dy i celou spole\u010dnost.<\/p>\n\n\n\n<p>Podvody stoj\u00ed da\u0148ov\u00e9 poplatn\u00edky spoustu pen\u011bz a v\u0161ichni za n\u011b plat\u00edme. Studie z roku 2017 odhalila, \u017ee jen kv\u016fli nedostate\u010dn\u00e9mu oznamov\u00e1n\u00ed podvod\u016f v oblasti ve\u0159ejn\u00fdch zak\u00e1zek p\u0159ich\u00e1z\u00ed EU ka\u017edoro\u010dn\u011b o 5,8 a\u017e 9,6 miliardy eur.
