Kone\u010dn\u00e9 zm\u011bny navr\u017een\u00e9 Media\u010dn\u00edm v\u00fdborem byly p\u0159ijaty Spolkov\u00fdm sn\u011bmem a Spolkovou radou 18. kv\u011btna 2023 a z\u00e1kon vstoup\u00ed v platnost 2. \u010dervence 2023. Z\u00e1kon o whistleblowerech bude platit okam\u017eit\u011b pro spole\u010dnosti s v\u00edce ne\u017e 250 zam\u011bstnanci, zat\u00edmco spole\u010dnosti s men\u0161\u00edm po\u010dtem zam\u011bstnanc\u016f maj\u00ed na implementaci nov\u00e9ho z\u00e1kona \u010das do 17. prosince 2023.<\/p>\n\n\n\n<p>Z\u00e1kon o whistleblowerech se bude vztahovat na v\u0161echna ozn\u00e1men\u00ed &#8222;z\u00e1va\u017en\u00fdch poru\u0161en\u00ed&#8220; v souvislosti s prac\u00ed, v\u010detn\u011b trestn\u00fdch \u010din\u016f a n\u011bkter\u00fdch spr\u00e1vn\u00edch delikt\u016f. Poru\u0161en\u00ed intern\u00edch podnikov\u00fdch z\u00e1sad jsou v\u0161ak z rozsahu ochrany vylou\u010dena. Vzhledem k tomu, \u017ee ochrana oznamovatel\u016f je z\u00e1kladn\u00edm prvkem, stanov\u00ed z\u00e1kon z\u00e1kaz odvetn\u00fdch opat\u0159en\u00ed, a to i v p\u0159\u00edpad\u011b, \u017ee se o n\u011b n\u011bkdo pouze pokus\u00ed. Za \u00fa\u010delem dal\u0161\u00ed ochrany oznamovatel\u016f stanov\u00ed z\u00e1kon obr\u00e1cen\u00e9 d\u016fkazn\u00ed b\u0159emeno. V ka\u017ed\u00e9 f\u00e1zi procesu mus\u00ed b\u00fdt zachov\u00e1na d\u016fv\u011brnost toto\u017enosti chr\u00e1n\u011bn\u00fdch osob. T\u00edm se rovn\u011b\u017e chr\u00e1n\u00ed v\u0161ichni, kdo jsou v ozn\u00e1men\u00ed zm\u00edn\u011bni, p\u0159ed odhalen\u00edm.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Jak\u00e9 jsou hlavn\u00ed v\u00fdzvy pro n\u011bmeck\u00e9 spole\u010dnosti a organizace?<\/h2>\n\n\n\n<p>Pro N\u011bmecko, kter\u00e9 se nach\u00e1z\u00ed ve st\u0159edu Evropy, kde s\u00eddl\u00ed mnoho mezin\u00e1rodn\u00edch spole\u010dnost\u00ed, to bylo velmi n\u00e1ro\u010dn\u00e9 \u010dek\u00e1n\u00ed na transpozici <a href=\"https:\/\/www.whistlelink.com\/cs\/smernice-eu-o-ochrane-osob\/\" target=\"_blank\" rel=\"noreferrer noopener\">sm\u011brnice EU o whistleblowingu<\/a>. Po tomto dlouh\u00e9m stavu nejistoty, kdy jsme nev\u011bd\u011bli, jak nov\u00fd z\u00e1kon ovlivn\u00ed podnik\u00e1n\u00ed a jak\u00e1 opat\u0159en\u00ed je t\u0159eba p\u0159ijmout, jsem velmi r\u00e1d, \u017ee se bl\u00ed\u017e\u00edme k nov\u00e9mu z\u00e1konu.<\/p>\n\n\n\n<p>Zat\u00edmco mnoho \u010dlensk\u00fdch st\u00e1t\u016f EU ji\u017e nov\u00e9 z\u00e1kony zavedlo, v N\u011bmecku mnoho spole\u010dnost\u00ed zaujalo vy\u010dk\u00e1vac\u00ed p\u0159\u00edstup. Nyn\u00ed, kdy\u017e je z\u00e1kon o whistleblowerech kone\u010dn\u011b k dispozici, nastal \u010das prov\u00e9st pot\u0159ebn\u00e9 \u00fapravy v podnikov\u00fdch jednotk\u00e1ch.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Jak\u00e9 jsou nej\u010dast\u011bj\u0161\u00ed obavy nebo ot\u00e1zky, kter\u00e9 sl\u00fdch\u00e1te od klient\u016f?<\/h2>\n\n\n\n<p>Udr\u017eov\u00e1n\u00ed \u0159\u00e1dn\u00fdch kan\u00e1l\u016f pro pod\u00e1v\u00e1n\u00ed zpr\u00e1v nen\u00ed pro v\u011bt\u0161\u00ed organizace \u017e\u00e1dnou novinkou a je obvykle sou\u010d\u00e1st\u00ed jejich pr\u00e1ce v oblasti ESG. Men\u0161\u00ed organizace \u010dasto pot\u0159ebuj\u00ed poradit, jak strukturovat sv\u00e9 postupy vykazov\u00e1n\u00ed a vytvo\u0159it r\u00e1mec kolem kan\u00e1lu pro vykazov\u00e1n\u00ed.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Jak\u00e9 povinnosti maj\u00ed organizace podle z\u00e1kona a jak\u00e9 jsou sankce pro spole\u010dnosti, kter\u00e9 z\u00e1kon nedodr\u017euj\u00ed?<\/h2>\n\n\n\n<p>V\u0161echny organizace s 50 a v\u00edce zam\u011bstnanci mus\u00ed zav\u00e9st bezpe\u010dn\u00e9 kan\u00e1ly pro pod\u00e1v\u00e1n\u00ed zpr\u00e1v a zp\u0159\u00edstupnit je.
