{"id":15040,"date":"2020-12-13T13:18:15","date_gmt":"2020-12-13T12:18:15","guid":{"rendered":"https:\/\/www.whistlelink.com\/?post_type=blog&#038;p=15040"},"modified":"2022-06-08T07:53:52","modified_gmt":"2022-06-08T07:53:52","slug":"que-es-whistleblowing","status":"publish","type":"blog","link":"https:\/\/www.whistlelink.com\/es\/blog\/que-es-whistleblowing\/","title":{"rendered":"\u00bfQu\u00e9 es whistleblowing?"},"content":{"rendered":"\n<p>El whistleblowing (la denuncia de irregularidades) es cuando alguien informa sobre una mala conducta, generalmente en un contexto laboral, en una organizaci\u00f3n p\u00fablica o privada. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-no-todo-lo-que-alguien-percibe-como-erroneo-es-whistleblowing\">No todo lo que alguien percibe como err\u00f3neo es whistleblowing.<\/h3>\n\n\n\n<p>La denuncia de irregularidades solo se deber\u00eda producir cuando la preocupaci\u00f3n es de inter\u00e9s p\u00fablico y pensamos que puede afectar a los dem\u00e1s, es decir, a la empresa, clientes o al p\u00fablico en general.<\/p>\n\n\n\n<p>Por lo tanto, se trata de una actividad o un <strong>comportamiento ilegal, poco \u00e9tico o perjudicial<\/strong> ocurrida en el pasado, en el presente o que pueda ocurrir en el futuro. Ejemplos:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>fraude o corrupci\u00f3n<\/li><li>acoso, intimidaci\u00f3n y discriminaci\u00f3n<\/li><li>incumplimiento de las normas de salud y seguridad<\/li><li>da\u00f1os al medioambiente, bienes o propiedades<\/li><li>incumplimiento deliberado de la ley<\/li><\/ul>\n\n\n\n<div style=\"height:30px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-cuando-no-se-trata-de-whistleblowing\">Cuando no se trata de whistleblowing<\/h3>\n\n\n\n<p>El whistleblowing no es una queja personal, como el comportamiento de un compa\u00f1ero, un trato injusto o un incumplimiento de los derechos laborales. Generalmente estos casos se gestionan seg\u00fan el procedimiento interno, a trav\u00e9s del departamento de Recursos Humanos.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-denuncias-internas-o-externas\">Denuncias internas o externas<\/h3>\n\n\n\n<p>Las denuncias internas se hacen dentro de la empresa, a trav\u00e9s de canales de comunicaci\u00f3n como un portal en l\u00ednea, tel\u00e9fono, mensaje de voz o carta. Que los empleados presenten denuncias internas ayuda a las organizaciones a ser conscientes de un problema y a actuar al respecto en una fase temprana.<\/p>\n\n\n\n<p>Las denuncias externas son cuando alguien destapa una irregularidad en un canal externo a la organizaci\u00f3n, como a los medios de comunicaci\u00f3n, la polic\u00eda o un departamento gubernamental. Esto puede ocurrir cuando faltan los canales internos, o cuando no se ha hecho un seguimiento serio de un problema ya denunciado internamente. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-cualquiera-puede-denunciar\">Cualquiera puede denunciar<\/h3>\n\n\n\n<p>No solo los empleados actuales pueden informar de infracciones. Cualquier persona estrechamente relacionada con una organizaci\u00f3n puede plantear una inquietud si sospecha de una mala conducta, como empleados anteriores, clientes, proveedores, solicitantes de empleo, contratistas, etc. Sea quien sea, solo debe hacerlo de buena fe.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-por-que-denunciar-es-un-tema-candente\">\u00bfPor qu\u00e9 denunciar es un tema candente?<\/h3>\n\n\n\n<p>En 2019, en la UE entr\u00f3 en vigor la Directiva 2019\/1937 sobre la protecci\u00f3n de las personas que denuncian incumplimiento de las leyes europeas. Su objetivo es proteger mejor al denunciante, es decir, al que informa sobre estas infracciones. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-a-quien-se-dirige\">\u00bfA quien se dirige?<\/h3>\n\n\n\n<p>La Directiva exige que las empresas de la UE con m\u00e1s de 50\u00a0empleados implementen canales de denuncia internos.
