Dup\u0103 o \u00eent\u00e2rziere considerabil\u0103, proiectul de lege a fost trimis spre revizuire timp de \u0219ase s\u0103pt\u0103m\u00e2ni, a\u0219a cum a anun\u021bat guvernul federal la \u00eenceputul lunii iunie 2022.&nbsp;<\/p>\n\n\n\n<p>Un raport comun publicat de Transparency International \u0219i Whistleblowing International Network \u00een februarie 2021 a constatat c\u0103 Austria a f\u0103cut progrese minime \u00een transpunerea directivei \u0219i c\u0103 procesul nu a fost nici transparent, nici cuprinz\u0103tor.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Belgia&nbsp;<\/h3>\n\n\n\n<p>Recent Belgia a \u00eenregistrat unele progrese \u00een ceea ce prive\u0219te transpunerea Directivei Whistleblowing a UE \u00een legisla\u021bia na\u021bional\u0103. \u00cen prezent, Guvernul Federal elaboreaz\u0103 legisla\u021bia pentru sectorul privat. Majoritatea este \u00een favoarea includerii unor sectoare suplimentare considerate cu risc ridicat, a persoanelor care raporteaz\u0103 ac\u021biuni considerate ilegale \u00een legisla\u021bia na\u021bional\u0103 \u0219i a informa\u021biilor de interes public.&nbsp;<\/li><li>Ce institu\u021bii ar trebui s\u0103 acopere canalele externe de avertizare. Pe de alt\u0103 parte, temerile c\u0103 sistemul ar putea fi abuzat de cei cu rea-credin\u021b\u0103 sunt v\u0103zute drept motive pentru a nu face acest lucru.&nbsp;<\/li><\/ul>\n\n\n\n<p><strong>Croa\u0163ia<\/strong><\/p>\n\n\n\n<p>A fost adoptat\u0103 o nou\u0103 lege privind protec\u021bia avertizorilor, ceea ce face din Croa\u021bia a noua \u021bar\u0103 care a adoptat o lege na\u021bional\u0103 de whistleblowing. Legea a fost publicat\u0103 la 15 aprilie \u0219i a intrat \u00een vigoare la 23 aprilie. De\u0219i Croa\u021bia are o lege privind avertizorii \u00eenc\u0103 din 2019, au fost necesare modific\u0103ri semnificative pentru a se alinia la standardul minim din Directiva UE.&nbsp;&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Cipru<\/h3>\n\n\n\n<p>La 22 ianuarie 2022, parlamentul cipriot a adoptat o nou\u0103 lege na\u021bional\u0103 privind protec\u021bia avertizorilor intitulat\u0103; \u201eProtec\u021bia persoanelor care raporteaz\u0103 \u00eenc\u0103lc\u0103ri ale Legii Uniunii \u0219i ale Legii na\u021bionale din 2022\u201d.&nbsp;<\/p>\n\n\n\n<p>Noua lege se refer\u0103 \u00een primul r\u00e2nd la \u00eenc\u0103lc\u0103rile care ar putea d\u0103una altora sau ar putea d\u0103una mediului. Aceasta acoper\u0103, de asemenea, ter\u021be persoane cu leg\u0103turi cu avertizorul care ar putea suferi represalii.&nbsp;<\/p>\n\n\n\n<p>Legea cere organiza\u021biilor s\u0103 implementeze canale \u0219i procese interne de raportare care p\u0103streaz\u0103 anonimatul avertizorului.&nbsp; Va fi considerat\u0103 infrac\u021biune \u00eempiedicarea avertiz\u0103rii, represaliile sau \u00eencercarea de a dezv\u0103lui identitatea avertizorului care dore\u0219te s\u0103 \u00ee\u0219i p\u0103streze anonimatul.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Cehia<\/h3>\n\n\n\n<p>Proiectul de lege din Republica Ceh\u0103 nu a fost adoptat la timp din cauza alegerilor locale \u0219i trebuie retransmis Parlamentului. Roiectul dep\u0103\u0219e\u0219te cerin\u021bele minime ale directivei.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Danemarca<\/h3>\n\n\n\n<p><span data-contrast=\"auto\">Este prima \u021bar\u0103 care a transpus directiva \u00een legisla\u021bia na\u021bional\u0103. Noua lege privind protec\u021bia avertizorilor, numit\u0103 \u201e<a href=\"https:\/\/www.retsinformation.dk\/eli\/ft\/202013L00213\" target=\"_blank\" rel=\"noopener\">Lov om beskyttelse af whistleblowere<\/a>\u201d, <\/span>a fost adoptat\u0103 \u00een iunie 2021 \u0219i a intrat acum \u00een vigoare odat\u0103 cu termenul Uniunii.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Legea danez\u0103 extinde domeniul de aplicare a Directivei dincolo de legisla\u021bia Uniunii, incuz\u00e2nd \u0219i \u00eenc\u0103lc\u0103rile de natur\u0103 grav\u0103, cum ar fi h\u0103r\u021buirea sexual\u0103 sau alte conflicte personale grave la locul de munc\u0103. Cu toate acestea, nu include protec\u021bie pentru avertizorii care informeaz\u0103 cu privire la securitatea na\u021bional\u0103 sau informa\u021biile medicale acoperite de Legea s\u0103n\u0103t\u0103\u021bii.&nbsp;<span data-contrast=\"auto\">&nbsp;&nbsp;<\/span><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Estonia<\/h3>\n\n\n\n<p>Un nou proiect de lege privind protec\u021bia avertizorilor a fost aprobat de Guvernul Estoniei. Proiectul de lege a fost trimis Parlamentului unde a trecut \u00een prima lectur\u0103. Se estimeaz\u0103 c\u0103 noua lege va intra \u00een vigoare \u00een iunie 2022.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Finlanda<\/h3>\n\n\n\n<p>Consultarea public\u0103 cu privire la proiectul de lege s-a \u00eencheiat \u00een august 2021, iar propunerea trebuia ini\u021bial prezentat\u0103 \u00een Parlament \u00een septembrie 2021. \u00cen urma feedback-ului cu privire la proiectul de lege a Guvernului, grupul de lucru care preg\u0103te\u0219te legisla\u021bia finlandez\u0103 a am\u00e2nat de dou\u0103 ori termenul limit\u0103, pentru a introduce modific\u0103ri.&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Fran\u0163a<\/h3>\n\n\n\n<p>Parlamentul Fran\u021bei a adoptat o nou\u0103 legisla\u021bie \u2013 <a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000045388745\" target=\"_blank\" rel=\"noreferrer noopener\">Legea nr. 2022-401 pentru \u00eembun\u0103t\u0103\u021birea protec\u021biei avertizorilor<\/a>, denumit\u0103 \u0219i Legea Wasermann, la 22 februarie. Noua lege dep\u0103\u0219e\u0219te legea Sapin 2 a Fran\u021bei \u0219i cerin\u021bele minime ale Directiva UE, incluz\u00e2nd \u0219i sanc\u021biuni \u0219i r\u0103spundere personal\u0103 \u00een cazul \u00een care organiza\u021biile nu se conformeaz\u0103.&nbsp;<\/p>\n\n\n\n<p>Pentru mai multe informa\u021bii, citi\u021bi aceast\u0103 postare despre <a href=\"https:\/\/www.whistlelink.com\/blog\/france-transposes-eu-whistleblowing-directive-into-national-law\/\" target=\"_blank\" rel=\"noreferrer noopener\">noua lege francez\u0103<\/a>.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Germania<\/h3>\n\n\n\n<p>\u00cen urma respingerii proiectului de lege prezentat ini\u021bial \u00een decembrie 2020 de c\u0103tre partidul CDU\/CSU, un alt proiect de lege este \u00een curs de elaborare \u00een Germania.&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<p>Viitorul guvern german \u0219i-a declarat angajamentul fa\u021b\u0103 de o transpunere responsabil\u0103 a Directivei Whistleblowing a UE, afirm\u00e2nd c\u0103 scopul <em>\u201ea fost de a \u00eembun\u0103t\u0103\u021bi drepturile avertizorilor\u201d<\/em>. Se discut\u0103 \u0219i introducerea de sanc\u021biuni organiza\u021biilor care nu se conformeaz\u0103.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Grecia&nbsp;<\/h3>\n\n\n\n<p>Introducerea unei noi legi privind protec\u021bia avertizorilor \u00een Grecia a fost am\u00e2nat\u0103, societatea civil\u0103 declar\u00e2nd c\u0103 reformelor legale le-a lipsit transparen\u021ba \u0219i incluziunea. Ministerul Justi\u021biei nu a furnizat \u00eenc\u0103 nicio informa\u021bie cu privire la proces.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Ungaria&nbsp;<\/h3>\n\n\n\n<p>Ungaria r\u0103m\u00e2ne singurul stat membru care nici m\u0103car nu a \u00eenceput transpunerea Directivei pentru protec\u021bia avertizorilor. Societatea civil\u0103 \u0219i-a exprimat \u00eengrijorarea c\u0103 Ungaria este singura \u021bar\u0103 din UE care nu a f\u0103cut niciun pas \u00een vederea transpunerii Directivei.&nbsp;&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Irlanda<\/h3>\n\n\n\n<p>Un nou proiect de lege privind protec\u021bia avertizorilor a fost publicat \u00een Irlanda \u00een februarie 2022. Acesta urm\u0103re\u0219te s\u0103 transpun\u0103 Directiva UE \u00een legisla\u021bia na\u021bional\u0103 irlandez\u0103 prin modificarea actualei legi din 2014.&nbsp;<\/p>\n\n\n\n<p>Transparency International Ireland \u0219i-a exprimat \u00eengrijorarea c\u0103 unele m\u0103suri ar putea chiar sl\u0103bi protec\u021bia existent\u0103 pentru avertizorii irlandezi. Acest lucru ar duce la \u00eenc\u0103lcarea Directivei, care prevede c\u0103 transpunerea nu ar trebui, \u00een niciun caz, s\u0103 reduc\u0103 nivelul de protec\u021bie deja oferit de statele membre. Legea este actualmente sub analiz\u0103 pentru a fi luate \u00een considerare recomand\u0103rile.&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Italia<\/h3>\n\n\n\n<p>La 8 mai 2021, Legea din 22 aprilie 2021 nr. 53 a intrat \u00een vigoare. Aceast\u0103 lege prevede adoptarea, \u00een temeiul art. 1, decretelor legislative pentru transpunerea Directivelor europene \u0219i punerea \u00een aplicare a altor acte ale Uniunii, aceasta incluz\u00e2nd transpunerea Directivei Whistleblowing. Cu toate acestea, p\u00e2n\u0103 la sf\u00e2r\u0219itul lunii noiembrie 2021, a devenit oficial c\u0103 Italia va \u00eent\u00e2rzia adoptarea sa.&nbsp;<\/p>\n\n\n\n<p>Transparency International Italy \u0219i Good Lobby au sus\u021binut o conferin\u021b\u0103 de pres\u0103 pentru a comenta lipsa de transparen\u021b\u0103 \u00een dezvoltarea legii \u0219i au cerut, de asemenea, ca etapele urm\u0103toare s\u0103 fie f\u0103cute mai inclusiv.&nbsp;&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Letonia&nbsp;<\/h3>\n\n\n\n<p>La 20 ianuarie 2022, Letonia a adoptat o lege privind protec\u021bia avertizorilor \u00een legisla\u021bia na\u021bional\u0103, primind elogii pentru includerea protec\u021biei \u00een mod special pentru avertizorii de riscuri climatice. Letonia este un lider emergent \u00een probleme climatice, a\u0219a cum arat\u0103 ambi\u021biosul s\u0103u Plan na\u021bional pentru Energie \u0219i Clim\u0103. P\u00e2n\u0103 acum, Letonia este singura \u021bar\u0103 care a inclus \u00een mod explicit protec\u021bia avertizorilor care aduc dovezi ale unor riscuri climatice. Noua lege extinde, de asemenea, domeniul de aplicare al Directivei pentru a proteja nu numai \u00eenc\u0103lc\u0103rile dreptului Uniunii, ci \u0219i \u00eenc\u0103lcarea legisla\u021biei na\u021bionale.&nbsp;&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Lituania<\/h3>\n\n\n\n<p>\u201eSeimas\u201d, Parlamentul lituanian, a adoptat o nou\u0103 lege privind avertizorii de integritate chiar \u00eenainte de termenul limit\u0103 al UE, la 16 decembrie 2021. Noua lege, care modific\u0103 Legea privind protec\u021bia avertizorilor nr. XIII-804, a intrat \u00een vigoare la 15 februarie 2022. Lituania a optat pentru termene limit\u0103 diferite \u00een compara\u021bie cu Directiva UE. Avertizorul va primi confirmarea recep\u021biei informa\u021biilor \u00een termen de dou\u0103 zile lucr\u0103toare, iar feedbackul cu privire la evolu\u021bia cazului trebuie s\u0103 fie transmis acestuia \u00een cel mult 10 zile lucr\u0103toare.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Luxemburg<\/h3>\n\n\n\n<p>Luxemburgul a dep\u0103\u0219it termenul limit\u0103 al UE, dar dup\u0103 aceea a prezentat Parlamentului \u0219i mass-mediei un proiect de lege privind protec\u021bia avertizorilor. Acesta este actualmente analizat de exper\u021bii \u00een protec\u021bia avertizorilor pentru a determina dac\u0103 este \u00een conformitate cu cerin\u021bele Directivei Whistleblowing \u0219i, de asemenea, cu cele mai bune practici. Proiectul de lege indic\u0103 faptul c\u0103 se vor extinde standardele minime stabilite \u00een Directiv\u0103, inclusiv \u00een ceea ce prive\u0219te protec\u021bia avertizorilor.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Malta<\/h3>\n\n\n\n<p>Un nou proiect de lege privind <a href=\"https:\/\/legislation.mt\/eli\/cap\/527\/eng\/pdf\" target=\"_blank\" rel=\"noreferrer noopener\">protec\u021bia avertizorilor (nr. 249)<\/a> a fost publicat f\u0103r\u0103 nicio consultare public\u0103 sau a p\u0103r\u021bilor interesate. Proiectul de lege propune amendamente la legisla\u021bia actual\u0103 a Maltei privind avertizarea de integritate (Capitolul 527 din 2013), pentru a se asigura c\u0103 aceasta este \u00een conformitate cu standardele minime ale Directivei.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Modific\u0103rile par s\u0103 se alinieze cerin\u021belor minime ale Directivei privind un cadru legislativ \u00eembun\u0103t\u0103\u021bit care s\u0103 protejeze avertizorii. Proiectul de lege pune un accent puternic pe confiden\u021bialitate \u0219i protec\u021bia datelor, care trebuie s\u0103 fie \u00een conformitate cu GDPR \u0219i cu Capitolul 586 al Maltei.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Polonia&nbsp;<\/h3>\n\n\n\n<p>Prima propunere de proiect a fost prezentat\u0103 \u00een octombrie 2021, iar anteproiectul a fost publicat \u00een aprilie, \u00een urma consult\u0103rilor publice care au inclus peste 800 de pagini de observa\u021bii la primul proiect. Versiunea actualizat\u0103 include modific\u0103ri precum extinderea protec\u021biei pentru lucr\u0103torii temporari sau stagiari, eliminarea pseudo-anonimiz\u0103rii cazurilor \u0219i reducerea perioadei de timp pentru p\u0103strarea \u00eenregistr\u0103rilor de date, de la 5 ani la 12 luni dup\u0103 finalizarea investiga\u021biei cazului.&nbsp;<\/p>\n\n\n\n<p>Actul va intra \u00een vigoare dup\u0103 dou\u0103 luni, organiza\u021biile private cu peste 250 de angaja\u021bi av\u00e2nd apoi \u00eenc\u0103 o lun\u0103 pentru a implementa canale de raportare interne.&nbsp;<\/p>\n\n\n\n<p>Cea mai controversat\u0103 parte a legii se refer\u0103 la poten\u021bialele sanc\u021biuni. Anteproiectul polonez propune o pedeaps\u0103 de p\u00e2n\u0103 la 3 ani de \u00eenchisoare sau restric\u021bionarea libert\u0103\u021bii pentru obstruc\u021bionarea raport\u0103rii, represalii \u00eempotriva avertizorului, dezv\u0103luirea ilegal\u0103 a identit\u0103\u021bii acestuia sau lipsa unei proceduri interne.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Portugalia&nbsp;<\/h3>\n\n\n\n<p>Pe 20 decembrie 2021 a fost publicat\u0103 <a href=\"https:\/\/www.parlamento.pt\/ActividadeParlamentar\/Paginas\/DetalheDiplomaAprovado.aspx?BID=23468\" target=\"_blank\" rel=\"noreferrer noopener\">Legea nr. 93\/2021<\/a>, care transpune Directiva Whistleblowing a UE. Aceast\u0103 nou\u0103 lege ofer\u0103 cadrul general pentru protec\u021bia avertizorilor, impun\u00e2nd organiza\u021biilor s\u0103 stabileasc\u0103 canale interne de avertizare \u0219i interzic\u00e2nd represaliile.
