I v\u00e5r miniserie kommer vi att ta en titt p\u00e5 n\u00e5gra olika visselbl\u00e5sarlagar i olika l\u00e4nder. &nbsp;&nbsp;<\/p>\n\n\n\n<h6 class=\"wp-block-heading\" id=\"h-i-forsta-delen-visselblasarlagar-i-de-storsta-engelsktalande-landerna\">I f\u00f6rsta delen, visselbl\u00e5sarlagar i de st\u00f6rsta engelsktalande l\u00e4nderna. &nbsp;&nbsp;<\/h6>\n\n\n\n<h3 class=\"wp-block-heading\">F\u00f6rst; hur kan vi definiera visselbl\u00e5sning\u00a0<\/h3>\n\n\n\n<p>&nbsp;Visselbl\u00e5sning \u00e4r n\u00e4r en person (ofta en anst\u00e4lld) avsl\u00f6jar information om&nbsp;organisationen. Det \u00e4r vanligt att man vill rapportera om n\u00e5got olagligt eller os\u00e4kert som sker p\u00e5 arbetsplatsen. F\u00f6r att ett \u00e4rende ska kunna klassas som visselbl\u00e5sning m\u00e5ste det vanligtvis vara av st\u00f6rre allm\u00e4nt intresse. Det betyder att handlingen ska p\u00e5verka fler \u00e4n bara medarbetarna i f\u00f6retaget eller branschen. De flesta visselbl\u00e5sare rapporterar sina iakttagelser internt inom f\u00f6retaget. De visselbl\u00e5sare som vi f\u00e5r h\u00f6ra om \u00e4r oftast de som delat sin ber\u00e4ttelse publikt, till exempel i media. &nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Europeiska unionen&nbsp;&nbsp;<\/h3>\n\n\n\n<p>2019 antog EU visselbl\u00e5sardirektivet, som alla f\u00f6retag med fler \u00e4n 250 anst\u00e4llda borde ha implementerat f\u00f6re 17&nbsp;december 2021. F\u00f6retag med mellan 50 och 250 anst\u00e4llda fick en extra tidsfrist om tv\u00e5 \u00e5r. De flesta av&nbsp;EU:s medlemsl\u00e4nder arbetar dock fortfarande med att uppdatera sina lagar s\u00e5 att de \u00f6verensst\u00e4mmer med inneh\u00e5llet i EU-direktivet.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Organisationerna m\u00e5ste s\u00e4kerst\u00e4lla f\u00f6ljande krav: &nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>S\u00e4kra interna kanaler och processer f\u00f6r visselbl\u00e5sning, samtidigt som den rapporterande personens identitet h\u00e5lls konfidentiell\u00a0<\/li><li>M\u00f6jlighet att l\u00e4mna in rapporter antingen skriftligt eller muntligt, genom att anv\u00e4nda en visselbl\u00e5sartj\u00e4nst online och\/eller en telefonjour eller r\u00f6stbrevl\u00e5da\u00a0<\/li><li>En utsedd beh\u00f6rig person eller avdelning som ska ta emot och f\u00f6lja upp visselbl\u00e5sarrapporter. Det kan till exempel vara en HR-chef, Compliance-avdelningen, ett juridiskt ombud, f\u00f6retagets CFO eller en extern\u00a0ombudsman eller tj\u00e4nst. \u00a0<\/li><li>Se till att ordna ett fysiskt m\u00f6te om uppgiftsl\u00e4mnaren beg\u00e4r det.\u00a0<\/li><\/ul>\n\n\n\n<div style=\"height:32px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p>Direktivet anger ocks\u00e5 att alla f\u00f6retag som p\u00e5 n\u00e5got s\u00e4tt hindrar visselbl\u00e5sare eller underl\u00e5ter att h\u00e5lla deras identitet konfidentiell,&nbsp;b\u00f6r straffas. B\u00e5de anst\u00e4llda och entrepren\u00f6rer \u00e4r garanterade yttrandefrihet samt skydd mot vederg\u00e4llning. Vid sidan av dessa lagar finns den ovanliga l\u00f6sningen av ett bel\u00f6ningsprogram (som man \u00e4ven hittar i andra l\u00e4nder, till exempel i Singapore d\u00e4r man anv\u00e4nder det f\u00f6r att rapportera om karteller). Bel\u00f6ningsprogrammet inneb\u00e4r att visselbl\u00e5sare kan f\u00e5 ekonomiska bel\u00f6ningar om anklagelserna mot deras arbetsgivare accepteras. F\u00f6r att kvalificera sig f\u00f6r programmet <a href=\"https:\/\/en.wikipedia.org\/wiki\/Whistleblower_protection_in_the_United_States#Reporting\" target=\"_blank\" rel=\"noreferrer noopener\">m\u00e5ste man skicka in sin rapport antingen online<\/a> via specifika portaler, eller via e-post eller ett s\u00e4rskilt formul\u00e4r. Vissa av dessa bel\u00f6ningar \u00e4r till och med tillg\u00e4ngliga f\u00f6r visselbl\u00e5sare utanf\u00f6r USA.&nbsp;<\/p>\n\n\n\n<p>Till skillnad fr\u00e5n EU kr\u00e4ver inte federal lag att privat\u00e4gda f\u00f6retag har n\u00e5gra speciella visselbl\u00e5sarkanaler eller f\u00f6ljer n\u00e5gon viss procedur. En annan viktig sak att notera \u00e4r att fackf\u00f6reningsr\u00f6relsen \u00e4r stark i USA \u00e4r fackf\u00f6reningsr\u00f6relsen, och kan ge ytterligare r\u00e4ttsskydd \u00e5t fackf\u00f6reningsmedlemmar.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Kanada&nbsp;<\/h3>\n\n\n\n<p>Man kan bli aningen f\u00f6rv\u00e5nad \u00f6ver att hitta Kanada bland de l\u00e4nder som har en historia av d\u00e5ligt lagstiftningsskydd f\u00f6r visselbl\u00e5sare. Faktum \u00e4r att Kanada rankades s\u00e4mst tillsammans med Libanon och Norge i en <a href=\"https:\/\/www.ibanet.org\/MediaHandler?id=49c9b08d-4328-4797-a2f7-1e0a71d0da55\" target=\"_blank\" rel=\"noreferrer noopener\">rapport fr\u00e5n International Bar Association (2021)<\/a>. \u00c4ven om Kanada antog en visselbl\u00e5sarlag 2005, har <a href=\"https:\/\/nationalpost.com\/news\/canada\/canada-failed-to-protect-whistleblowers-ranks-last-among-nations-with-protection-laws\" target=\"_blank\" rel=\"noreferrer noopener\">man anklagat den kanadensiska regeringen<\/a> f\u00f6r att varken ha anv\u00e4nt eller sett \u00f6ver sitt system. Det finns en lag om skydd f\u00f6r offentliga tj\u00e4nstem\u00e4n (PSDPA), men den <a href=\"https:\/\/cfe.ryerson.ca\/sites\/default\/files\/whats_wrong_with_the_psdpa.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">kritiserades ocks\u00e5 starkt i en rapport<\/a> av Center for Free Expression (2017).&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Storbritannien&nbsp;&nbsp;<\/h3>\n\n\n\n<p>Storbritannien har en historia av kraftfulla visselbl\u00e5sarlagar, som Public Interest Disclosure Act fr\u00e5n 1999 (PIDA). Lagarna \u00e4r inriktade p\u00e5 att skydda visselbl\u00e5saren fr\u00e5n repressalier (p\u00e5 liknande s\u00e4tt som lagarna i Nya Zeeland) men fokuserar inte p\u00e5 att man ska ha n\u00e5gon s\u00e4rskild process. &nbsp;&nbsp;<\/p>\n\n\n\n<p>Sj\u00e4lva definitionen av visselbl\u00e5sning har i Storbritannien reviderats s\u00e5 att inrapporterade \u00e4renden m\u00e5ste vara i allm\u00e4nhetens intresse (det vill s\u00e4ga, p\u00e5verka&nbsp;den bredare allm\u00e4nheten) f\u00f6r att r\u00e4knas som visselbl\u00e5sning. Visselbl\u00e5sarrapporter kan&nbsp;omfatta brott, underl\u00e5tenhet att f\u00f6lja en lag, or\u00e4ttvisor, h\u00e4lso- och s\u00e4kerhets\u00f6vertr\u00e4delser, milj\u00f6problem eller till och med att f\u00f6rs\u00f6ka d\u00f6lja missf\u00f6rh\u00e5llanden inom dessa omr\u00e5den. &nbsp;&nbsp;<\/p>\n\n\n\n<p>Fr\u00e5n och med januari 2020 \u00e4r Storbritannien inte l\u00e4ngre medlem i EU. Det finns dock fortfarande m\u00e5nga brittiska f\u00f6retag som kan beh\u00f6va f\u00f6lja EU-direktivet p\u00e5 grund av <a href=\"https:\/\/www.fieldfisher.com\/en\/insights\/the-eu-whistleblowing-directive-considerations-for\" target=\"_blank\" rel=\"noreferrer noopener\">handels- och samarbetsavtalet mellan Storbritannien och EU<\/a>. Det \u00e4r m\u00f6jligt att den brittiska regeringen kan beh\u00f6va ta h\u00e4nsyn till detta avtal n\u00e4r man granskar sin egen lagstiftning.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Australien&nbsp;<\/h3>\n\n\n\n<p>I Australien m\u00e5ste identiteten p\u00e5 visselbl\u00e5sare h\u00e5llas konfidentiell enligt lag (f\u00f6rutom i vissa fall). Australiensisk lagstiftning om visselbl\u00e5sning specificerar inga rapporteringsmetoder eller rutiner. Den inkluderar dock skydd f\u00f6r visselbl\u00e5sare whistleblowers som avsl\u00f6jar oegentligheter, till exempel brott mot f\u00f6retagets egen uppf\u00f6randekod. &nbsp;&nbsp;<\/p>\n\n\n\n<p>Dessutom anger utvidningen av \u201c<a href=\"https:\/\/asic.gov.au\/about-asic\/asic-investigations-and-enforcement\/whistleblowing\/\" target=\"_blank\" rel=\"noreferrer noopener\">the Corporate Ac<\/a>t\u201d (januari 2020), att vissa typer av enheter (till exempel offentliga f\u00f6retag) m\u00e5ste ha en visselbl\u00e5sarpolicy. Policyn m\u00e5ste inneh\u00e5lla information om r\u00e4ttsskydd, samt redog\u00f6ra f\u00f6r utredningsf\u00f6rfarandet. &nbsp;&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Nya Zeeland&nbsp;<\/h3>\n\n\n\n<p>Nya Zeeland uppdaterade 1 juli 2022 sin Protected Disclosure Act fr\u00e5n 2000. Det uppdaterade skyddet f\u00f6r visselbl\u00e5sare liknar i m\u00e5nga avseenden EU:s visselbl\u00e5sardirektiv. &nbsp;<\/p>\n\n\n\n<p>Viktiga f\u00f6r\u00e4ndringar inkluderar nya och mer detaljerade skyldigheter f\u00f6r mottagaren av visselbl\u00e5sarrapporter att bekr\u00e4fta mottagandet, utreda och behandla \u00e4rendet, informera den som rapporterat och motivera beslutet. Det g\u00f6r det ocks\u00e5 m\u00f6jligt f\u00f6r visselbl\u00e5sare att l\u00e4mna sin rapport direkt till en l\u00e4mplig myndighet och utvidgar definitionen av &#8221;allvarlig f\u00f6rseelse&#8221;.
