In our mini-series, we will look at some of the different whistleblower laws around the world. In this article, we\u2019ll mention a few other countries that aren\u2019t members of the European Union.\u00a0\u00a0<\/p>\n\n<p>Did you miss the first two parts? You can read them <a href=\"https:\/\/www.whistlelink.com\/sv\/blog\/visselblasarlagar-i-olika-lander\/\" target=\"_blank\" rel=\"noreferrer noopener\">here<\/a> and <a href=\"https:\/\/www.whistlelink.com\/sv\/blog\/visselblasarlagar-i-olika-lander-asien\/\" target=\"_blank\" rel=\"noreferrer noopener\">here<\/a>.\u00a0\u00a0<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-serbia\">Serbia\u00a0<\/h2>\n\n<p>Serbia\u2019s law on whistleblower protection has been <a href=\"https:\/\/www.balcanicaucaso.org\/eng\/Areas\/Serbia\/Whistleblowers-in-Serbia-a-model-law-184197\" target=\"_blank\" rel=\"noreferrer noopener\">regarded as a model law<\/a> by leading experts at an international level. Implemented in 2015, it is the first (and only) whistleblower law in the world where whistleblowers themselves have contributed to the draft. With more than 350 cases brought to the court of justice in its first two years, the law has exceeded all expectations.\u00a0<\/p>\n\n<p>The law aims to provide whistleblowers with the utmost protection and is often cited as an example of a highly elaborated regulatory act. One important detail is the omission of the notion of whistleblowing \u201cin good faith.\u201d Drafters of the law opposed this notion because delving into the reasons behind whistleblowing could lead to manipulation. \u00a0<\/p>\n\n<p>There is also a court issue of temporary protection measures which guarantees the whistleblower\u2019s reinstatement to their workplace in the event the dismissal proves to be illegal. This is an effective measure of dealing with retaliatory actions against whistleblowers and the whistleblower must only prove that this action occurred following the report. \u00a0<\/p>\n\n<h2 class=\"wp-block-heading\">Norway\u00a0<\/h2>\n\n<p>Whistleblowers in Norway are protected under the Norwegian Working Environment Act. This applies to individuals reporting \u2018censurable conditions&#8217; including breaches of law or ethical standards, danger to health and safety, climate or environmental hazards, corruption or financial crime, harassment, and breach of personal data security.\u00a0\u00a0<\/p>\n\n<p>For the purpose of whistleblowing claims, the definition of \u2018employees\u2019 is quite\u00a0broad. In addition to workers, groups that are considered \u2018employees\u2019 includes students, military personnel, inmates, patients, persons in work-oriented situations, and those in labour market schemes. Although fewer groups are covered than in the EU Whistleblowing Directive, the Norwegian legislation does cover a wider range of whistleblowing situations. \u00a0<\/p>\n\n<p>The authors of the <a href=\"https:\/\/www.ibanet.org\/MediaHandler?id=49c9b08d-4328-4797-a2f7-1e0a71d0da55\" target=\"_blank\" rel=\"noreferrer noopener\">International Bar Association\u2019s report<\/a> noted that Norway\u2019s strong labour laws already provide protection for employees, which may include cases of whistleblowing. \u00a0<\/p>\n\n<p>For more info about whistleblowing in Norway, please read our <a href=\"https:\/\/www.whistlelink.com\/blog\/interview-with-whistlelink-partner-helge-kvamme-from-kvamme-associates-norway\/\" target=\"_blank\" rel=\"noreferrer noopener\">Partner Interview with Kvamme Associates, Norway<\/a>.\u00a0<\/p>\n\n<h2 class=\"wp-block-heading\">South Africa\u00a0<\/h2>\n\n<p>South African protection for whistleblowers is primarily found in the <a href=\"https:\/\/www.gov.za\/sites\/default\/files\/gcis_document\/201409\/34572gon702.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Protected Disclosures Act<\/a> (2000). The legislation applies to employees in both the private and public sectors, but <a href=\"https:\/\/www.pinsentmasons.com\/out-law\/guides\/whistleblowing-legislation-in-south-africa\" target=\"_blank\" rel=\"noreferrer noopener\">excludes volunteers and independent contractors<\/a>. It aims to prevent backlash or repercussions from employers, and to ensure that <a href=\"http:\/\/www.psc.gov.za\/documents\/docs\/guidelines\/PSC_odac_update.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">whistleblowers feel safe<\/a> and free to raise concerns.\u00a0\u00a0<\/p>\n\n<p>Disclosures can be made to a variety of authorities and individuals, with special public protection agencies provided (Public Protector and Auditor-General). The idea is that it is much more beneficial for the employer and employee if disclosures are made internally, rather than externally (i.e., to the media).\u00a0\u00a0<\/p>\n\n<h2 class=\"wp-block-heading\">Brazil\u00a0<\/h2>\n\n<p>A relative newcomer to whistleblower protection legislation, Brazil implemented <a href=\"https:\/\/compliancecosmos.org\/introduction-brazils-new-whistleblower-protection-law\" target=\"_blank\" rel=\"noreferrer noopener\">Article 15 of Federal Law 13.964<\/a> (The Anticrime Law) in 2019. This applies not only to public corruption cases, but also to government-organisation related fraud, criminal activities, and administrative misconduct in the public interest. Similar to \u2018bounties\u2019 in the US, there is even a monetary reward for whistleblowing. These rewards are specified\u00a0as 5% of the funds recovered by the government. Safeguards include the usual confidentiality, protection against retaliation, and immunity from civil and criminal liability. There is also protection afforded by the Brazilian Victim and Witness Protection Act.\u00a0<\/p>\n\n<h2 class=\"wp-block-heading\">Argentina\u00a0<\/h2>\n\n<p>Section 41 of\u00a0 the Argentine Criminal Code <a href=\"https:\/\/inter-american-law-review.law.miami.edu\/global-corruption-localized-procedures-whistleblowing-protections-americas\/\" target=\"_blank\" rel=\"noreferrer noopener\">grants protection<\/a> and a different kind of incentive to whistleblowers. Instead of financial reward, those revealing information about crimes of corruption, fraud and financial offences may benefit from reduced penalties. However, an <a href=\"https:\/\/www.oecd.org\/corruption\/anti-bribery\/OECD-Argentina-3bis-follow-up-report-ENG.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">OECD report from 2019<\/a> states that there is no current legislation specifically protecting whistleblowers. Companies in the private sector must comply with the Corporate Liability Law, although there is only a recommendation for companies to have a whistleblower protection policy. According to the OECD report, Argentina has taken some steps to streamline the reporting process in the public sector.\u00a0<\/p>\n\n<h2 class=\"wp-block-heading\">Colombia\u00a0<\/h2>\n\n<p>Colombia\u2019s record of whistleblowing is rather different, as there is currently <a href=\"https:\/\/www.oecd.org\/corruption\/Colombia-Phase-3-Report-ENG.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">no legislation<\/a> regarding whistleblowing. Despite <a href=\"https:\/\/www.ganintegrity.com\/portal\/country-profiles\/colombia\/\" target=\"_blank\" rel=\"noreferrer noopener\">high levels of corruption<\/a>, any bills proposing whistleblower protection are <a href=\"https:\/\/www.bh-compliance.com\/en\/transparency-for-colombia-calls-for-protecting-corruption-whistleblowers\/\" target=\"_blank\" rel=\"noreferrer noopener\">often rejected<\/a>. An <a href=\"https:\/\/www.oecd.org\/newsroom\/oecd-welcomes-foreign-bribery-enforcement-efforts-and-urges-colombia-to-mobilise-key-government-and-law-enforcement-agencies-in-the-fight-against-foreign-bribery.htm\" target=\"_blank\" rel=\"noreferrer noopener\">OECD anti-bribery evaluation<\/a> published in 2019 urged the government to \u2018adopt whistleblower protection legislation that provides clear and comprehensive protections (sic.) from retaliation to whistleblowers across the public and private sectors.\u2019 The Practitioner\u2019s Guide to Global Investigations, Fourth Edition <a href=\"https:\/\/globalinvestigationsreview.com\/guide\/the-practitioners-guide-global-investigations\/2020\/article\/colombia\" target=\"_blank\" rel=\"noreferrer noopener\">Colombia article published in 2020<\/a> states that while there is a protection programme in place for informers and victims, in high-profile cases whistleblowers may ask for protection as well. It also mentions financial incentives for whistleblowers, authorised by the Ministry of Defence.\u00a0<\/p>\n\n<h2 class=\"wp-block-heading\">Whistleblower protection is important for everyone\u00a0\u00a0<\/h2>\n\n<p>Legislation may vary from country to country, but one thing is clear. It\u2019s in the interest of all parties to have safe and confidential systems for whistleblowers to report misconduct.
